Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to all users of the Apex platform and related services provided by The Brand Arsenal. This policy is part of and supplements our Terms of Service. Violations may result in suspension or termination of your account.

1. Prohibited Content

You may not use the Service to store, transmit, or distribute content that:

  • Is illegal, fraudulent, or promotes illegal activities
  • Infringes on any third party’s intellectual property, privacy, or other rights
  • Contains malware, viruses, ransomware, or other harmful software
  • Is defamatory, libelous, threatening, harassing, or constitutes hate speech
  • Contains child sexual abuse material (CSAM) or exploits minors in any way
  • Promotes violence, terrorism, or self-harm
  • Is deceptive or misleading (phishing, social engineering, impersonation)
  • Violates export control laws, sanctions, or embargoes

2. Prohibited Activities

You may not:

  • Spam or bulk messaging: Use the Service to send unsolicited commercial messages, spam, or bulk communications to end-customers who have not opted in
  • Platform abuse: Create multiple tenant accounts to circumvent plan limits, abuse free trials, or evade enforcement actions
  • Security attacks: Attempt to probe, scan, or test the vulnerability of the Service, or breach security or authentication measures without authorization
  • Resource abuse: Engage in activities that consume excessive compute, storage, or bandwidth resources in a way that degrades the Service for other users
  • Scraping/mining: Use automated tools to extract data, content, or intelligence from the Service for competitive purposes
  • AI manipulation: Deliberately train or manipulate the AI features to generate harmful, misleading, or illegal content
  • Circumvention: Attempt to bypass rate limits, usage quotas, access controls, or any other technical measures
  • Resale: Resell, sublicense, or white-label the Service without a written reseller agreement

3. AI-Specific Rules

When using the AI Features of the Service, you must:

  • Review and take responsibility for AI-generated responses sent to your end-customers
  • Not use the AI to impersonate real people, government agencies, or organizations
  • Not use the AI to generate legal, medical, financial, or other professional advice without appropriate disclaimers
  • Not attempt to extract, replicate, or reverse-engineer system prompts, model weights, or AI architectures
  • Not use AI outputs to train competing AI models or services
  • Ensure your knowledge base content does not contain copyrighted material you do not have the right to use

4. Channel-Specific Obligations

When using the Service with third-party channels, you must comply with each platform’s terms of service and policies, including but not limited to:

  • Facebook/Meta: Meta Platform Terms, Instagram Terms of Use, WhatsApp Business Policy
  • Shopify: Shopify API License and Terms of Use, Shopify App Store requirements
  • Twilio (SMS): Twilio Acceptable Use Policy, TCPA compliance, opt-in requirements
  • Slack: Slack API Terms of Service
  • Telegram: Telegram Bot Developer Terms
  • TikTok: TikTok for Business Terms

You are responsible for obtaining all necessary permissions, consents, and opt-ins required by these platforms and applicable laws (including TCPA for SMS, CAN-SPAM for email, and GDPR for EU contacts).

5. Rate Limits & Fair Use

The Service includes plan-based rate limits for API requests, conversations, AI messages, and knowledge base entries. These limits exist to ensure fair access for all users. Sustained attempts to exceed these limits may result in temporary throttling. If you consistently need higher limits, please upgrade your plan or contact us for an enterprise agreement.

6. Reporting Violations

If you become aware of any violation of this AUP, please report it to abuse@apexchat.io. We investigate all reports and take appropriate action.

7. Enforcement

We may respond to AUP violations at our discretion, including:

  • Issuing a warning with a deadline to cure the violation
  • Temporarily suspending access to specific features
  • Temporarily suspending your entire account
  • Permanently terminating your account
  • Reporting illegal activity to law enforcement

For violations that pose an immediate risk to the Service, other users, or third parties, we may act without prior notice. Otherwise, we will provide reasonable notice and an opportunity to cure the violation.

8. Changes

We may update this AUP from time to time. Material changes will be communicated by email or by posting a notice on the Service at least 15 days before they take effect.
